We bought a unit that has a restaurant on it. it was deemed that the restaurant is trading illegaly since it is zoned for resedential use. the want to rezone it to comercial 1. what will the implications be for persons owning units on the same property. can the owner build any structure? if so what can we as owners put in place to stop him from building a high rise restaurant and obstruct our view? how will the rezoning affect rates and us in general?

Dear Cray,
When it comes to matters of rezoning, the waters are always muddy and the best advise is that you should appoint your own Town Planner to provide you with proper advise. They generally don't cheap, but then seeing that you can club together with a few of your neighbours, the pain can be eased somewhat. A point to note is that you have various opportunities to object to the rezoning application, which the applicant has to advertise on the site. Once the objection is registered, the Municipality is obligated to keep you informed, with sufficient notice, of the entire process prior to making a decision to approve. I hope this helps somewhat.
